Terms of Service

By using SignSend ("the Service"), you agree to these Terms of Service. Please read them carefully.

Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use SignSend.

Acceptable Use

You agree to use SignSend only for lawful purposes. You may not upload content that is illegal, fraudulent, or infringes on others' rights. We reserve the right to suspend accounts that violate these terms.

Electronic Signatures

SignSend facilitates electronic signatures in accordance with the ESIGN Act and UETA (United States): each signer gives explicit consent, the signature is attributed to them with a timestamp and IP address, and the record is retained with the document. SignSend does not provide qualified or advanced electronic signatures under the EU eIDAS Regulation. Electronic signatures created through SignSend are legally binding where permitted by law. You are responsible for ensuring electronic signatures are appropriate for your specific use case.

Document Storage

Documents uploaded to SignSend are stored privately on our own servers, outside the public web root, and are reachable only by the account that owns them, its teammates on the same plan, and the signing links the account issues. Once everyone has signed, the completed copy is also emailed to the signers, the sender and, except for bulk sends, the sender's team; a guest who signs through a public link saves their copy from the last screen instead of receiving it by email. They are not encrypted at rest. We maintain backups but recommend you keep your own copies. We are not liable for data loss beyond reasonable measures.

Subscription and Billing

Paid plans are billed monthly or yearly, whichever you pick on the pricing page. You may cancel at any time from your account page. All payments are final and partial billing periods are not refunded; the only exceptions are listed in our Refund Policy. The free demo is one document per account, as described on our pricing page.

Renewals and failed payments. Your subscription renews automatically until you cancel it. When a new billing period begins, access for that whole period is granted and the payment for it is due. If the charge does not go through, the payment remains due and we retry it. Cancelling after a new period has begun only switches off later renewals; it does not cancel the payment for the period that has already started. Such a renewal charge is not refundable, and your access continues until the end of that paid period. The fee is for access to the service for the period, not for using it, so not having used the service is not a ground for a refund.

Limitation of Liability

SignSend is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

Termination

We may terminate or suspend your account at any time for violations of these terms. You may delete your account at any time by contacting [email protected].

Changes to Terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the new terms.
